Overview

This consultation sets out proposals for the transposition of Directive 2014/52/EU (the “2014 Directive”) in relation to the consenting regime for nuclear reactor decommissioning and dismantling projects.  The 2014 Directive amends Directive 2011/92/EU (the “EIA Directive”) on the assessment of the effects of certain public and private projects on the environment.

The Department for Business, Energy and Industrial Strategy (BEIS) is responsible for the policy relating to nuclear reactor decommissioning, and the Nuclear Reactors (Environmental Impact Assessment for Decommissioning) Regulations 1999 (as amended) (the “EIADR”). The EIADR implements the requirements of the EIA Directive in respect of nuclear reactor decommissioning and dismantling projects.  This consultation invites comments on proposed amendments to the EIADR in order to transpose the requirements of the 2014 Directive in respect of nuclear commissioning and dismantling projects in Great Britain.

When considering responses to this consultation, the Government will give greater weight to responses that are based on argument and evidence, rather than simple expressions of support or opposition.

What happens next

This consultation is now closed.

We will review the responses to the proposals and publish the Government Response to the consultation in due course. Subject to the responses received, we will set out our intentions of how and when we will implement the proposals on changes to the existing Regulations to effect transposition of the 2014 Directive amendments.
